So this really does happen? How do drivers think they can get away with this?
I don't understand.
Whomever you heard it from, they must have been talking about how the liability and faults would likely fall on the drivers as independent contractors. If there is a wreck, the liable party will be determined from those directly involved.
Uber will try to keep a safe distance. The story would be very different if they were an employer, but...
Is it me or is this like the most asked question on this forum?
How in the world do you know they are prostitutes? Just by the way they are dressed?
It is true that in a private place like someone else's car, you do not have a reasonable expectation of privacy. This means the driver can record you.
With that said, I don't think it matters whether you are in private or public places when it comes to recording your private conversations. In most states, the recoding party needs to have some kind of consent. I think. I am not lawyer.

Little surprised to hear that this is even a discussion point. I suppose plenty of drivers do this.
The thing is, I used to see this behavior a lot more with cabbies. They'd be all in the zone, constantly talking to people, and you are just a bag of meat. No interactions except for when the money was exchanged.
Those times, I will admit; I eflt like they were all machines and I didn't mind them being replaced by future robot cars.
...and now it's happening. but Uber drivers are much better at NOT being on the phone. Oh, where shall my heart be.
